1. Introduction

These Terms of Service ("Terms") govern your use of kvasi ("the Service"), operated by Falck Studios AS, a company registered in Norway (Org. nr. 932 000 000).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Service Description

kvasi is an AI-powered language learning platform that uses spaced repetition techniques to help users learn languages. The Service may include:

• AI-generated language exercises and evaluations
• Spaced repetition scheduling for vocabulary and grammar
• Progress tracking and learning analytics
• User-generated and shared learning content

3. User Accounts

To use the Service, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 16 years of age to create an account and use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Upload harmful, offensive, or infringing content to the shared library
• Use automated tools to access the Service except as expressly permitted
• Reverse engineer or attempt to extract source code from the Service

5. Intellectual Property

The Service, including its design, code, AI models, algorithms, and content (excluding user-generated content), is the intellectual property of Falck Studios AS and is protected by copyright and other intellectual property laws.

Content you create within the Service remains yours, but you grant Falck Studios AS a non-exclusive license to use, store, and display it as needed to provide the Service.

6. AI-Generated Content

The Service uses artificial intelligence to generate exercises, evaluate responses, and provide feedback. AI-generated content is provided for educational purposes and may not always be accurate. Falck Studios AS does not guarantee the accuracy, completeness, or suitability of AI-generated content.

AI processing is performed within the European Union. Our AI services are powered by Azure OpenAI Service, operated by Microsoft under their Responsible AI guidelines. Microsoft does not use your data to train or improve their AI models.

7. Service Availability and Limitations

We strive to provide a reliable Service, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice.

Usage of AI features may be subject to rate limits and fair use policies.

8. Limitation of Liability

To the maximum extent permitted by Norwegian law, Falck Studios AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising from your use of the Service.

9. Termination

You may terminate your account at any time by contacting us at contact@falckstudios.com. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason with reasonable notice.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Norway. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Norwegian courts.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
